Phantom Public Beta Terms
1. Who provides Phantom
Phantom is provided by Paul Hickmott trading as Phantom, and the public business correspondence address is 179a Feltham Road, Ashford, Surrey, TW15 1BB. Contact: security@makephantom.com.
2. Eligibility and accounts
You must satisfy the age and territory rules shown by Phantom when registering. The intended minimum age is 14, but access may be unavailable where local law or an incomplete legal assessment requires this. Keep account credentials secure and provide accurate registration information.
3. Service and plans
Phantom offers free access where shown, paid recurring plans and one-time credit packs. Features may change, pause or fail. Keep your own copy of creations. The Store and Stripe checkout show the price and billing period before purchase. Starter, Creator and Pro subscriptions renew on the selected monthly or annual billing cycle until cancelled. Phantom Studios offers separately enabled usage billing for AI creations under section 9a below. Existing prepaid Studio video credits remain available; buying those credits did not authorise automatic usage billing.
4. Creating and publishing
New creations are private. Publication requires your deliberate Publish action. Prompts remain private. You are responsible for having the rights and permissions needed for prompts, uploads and publication.
5. Your rights and Phantom's licence
Phantom does not claim ownership of your creation. You retain whatever rights applicable law gives you. When you publish, you grant Phantom a limited, non-exclusive, worldwide licence to host, copy, display and distribute that creation only as needed to operate and promote its public page in the service. The licence ends when the item is unpublished or deleted, subject to reasonable technical processing and copies others already downloaded.
6. Acceptable use
You must follow the Acceptable Use Policy. Phantom may restrict material or accounts urgently for safety or legal reasons and may use warnings, temporary suspension or permanent termination proportionately.
7. Reviews, reports and appeals
Automated safety processing is distinct from selected quality investigation. Selected review remains unavailable unless its legal basis and controls are approved. Creation and profile reports are reviewed through protected processes. Appeals remain available by email at security@makephantom.com.
8. Retention and deletion
Applicable Privacy Notice ceilings govern prompts, temporary originals and deletion. A lawful, scoped hold may preserve necessary evidence. Unpublishing returns an item to the private Library; deletion is different and permanently removes surviving engagement.
9. Credits and payments
Credits are service allowances, not money. Subscription credit allowances are allocated monthly, including on annual plans. Ordinary credits fund supported creation tools; Previously purchased Studio credits fund video only and remain separate from the new Studio usage balance. The creation screen shows the applicable credit cost. Credits are reserved for an accepted job and settled or released according to its recorded outcome. Technical failures receive an idempotent restoration where applicable. Stripe processes payments. The browser return from checkout alone does not grant credits; confirmed payment is required. A technically complete result does not remove statutory rights. To stop future subscription renewals, use the billing portal when available or contact security@makephantom.com. Cancellation of renewal does not itself reverse an earlier charge. To request cancellation of a purchase, a refund or a remedy for a fault, contact security@makephantom.com with your account email and order reference. Statutory cancellation and consumer rights remain available where applicable; using credits is not treated by these terms alone as a waiver of those rights. Any lawful request to begin supply immediately and any acknowledgement affecting cancellation rights must be presented separately before it takes effect. 9a. Phantom Studios usage billing. Enabling Studios requires your explicit agreement to save a payment method with Stripe and authorise automatic usage payments. A £50 upfront payment creates £50 of prepaid usage balance and is applied against your first £50 of usage. The advance is non-refundable except where statutory cancellation, refund or other consumer rights apply. It is not charged again merely because another billing period starts. Studios covers AI picture, story and video creation. It has no monthly credit allowance. Each creation's GBP price is shown before submission; review it before creating. Browser-only QR codes do not incur a Studios usage charge. Queued and running jobs reserve their displayed price. Uncertain provider outcomes remain held while investigated; confirmed no-charge failures release the reservation. Weekly billing falls seven days after activation and every seven days thereafter. After applying the prepaid balance, an unpaid usage balance reaching £100 creates an earlier invoice. After that threshold invoice is confirmed paid, the limit increases to £200; after the next paid threshold invoice it becomes £300. The £300 limit continues thereafter. A weekly payment alone does not increase the limit. Weekly billing or the applicable threshold, whichever happens first, determines the next bill. Running jobs count against available spending headroom; jobs exceeding it are declined before provider submission. An outstanding invoice pauses new Studios creations. Usage is billed weekly regardless of amount. Balances below Stripe's £0.30 GBP minimum still receive a weekly statement and carry forward until collection is possible. The prepaid balance is applied once; usage is never billed twice. We email your usage breakdown, payment status and contact details. Stripe may require payment authentication. Unconfirmed or failed payments do not restore spending headroom. You may pause new Studios usage in your account at any time. Existing queued or running jobs and charges already incurred remain payable. Pausing does not cancel a separate Starter, Creator or Pro subscription. Cancel its renewal under Profile > Membership. Cancellation before renewal stops subsequent renewals and retains access for the paid period. Contact info@makephantom.com for payment questions, cancellation or statutory remedies. These terms do not by themselves waive any statutory right or authorise an unannounced charge.
10. Changes
Material contractual changes will receive clear notice and reacceptance where appropriate. Minor drafting changes are versioned.
11. Liability and consumer rights
Nothing excludes liability that cannot lawfully be excluded or limits mandatory consumer, privacy or cancellation rights. Beta limitations apply only to the extent permitted by law.
12. Governing position
These terms are intended to be governed by the law of England and Wales, while preserving mandatory rights in the user's country.
13. Song creation
Song uses Mureka to create music from your musical direction, lyrics and selected settings. Enter your own lyrics or choose Instrumental; automatic lyric writing and voice cloning are not offered. Tempo, vocal style and target duration are guidance rather than guaranteed exact controls. You must have permission to use any submitted lyrics or recording. A vocal reference guides a new song and does not promise an identical voice or preservation of the original recording. Song tokens are calculated from the configured provider route tariff, converted using Phantom's configured USD/GBP rate, plus 30%, divided by the shared token value and rounded up to a whole token. The token amount is shown before creation. A tariff estimate is not an observed per-request provider bill. Existing reservation, failure and statutory-rights provisions still apply. Studio is currently unavailable; separate vocal/track editing is not represented as a live feature until Studio is enabled.
